Constitution vs Sharia

In 2011, the Center for Security Policy assembled a 2 page flyer that succinctly explains the differences between the rights guaranteed in the US Constitution and Shariah.

CONSTITUTION:  ARTICLE  VI:   “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby”

CONSTITUTION:  FIRST AMENDMENT:  “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”

SHARIAH“Those who reject Islam must be killed. If they turn back (from Islam), take hold of them and kill them wherever you find them.” QURAN  4:89   “Whoever changed his [Is- lamic] religion, then kill him,” SAHIH AL-­BUKHARI,  9:84:57.  In historic and modern Shariah states, Shariah law enforces dhimmi status (second-class citizen, apartheid-type laws) on non-Muslims, prohibiting them from observing their religious practices publicly, building or repairing churches, raising their voices during prayer or ringing church bells; if dhimmi laws are violated in the Shariah State, penalties are those used for prisoners of war: death, slavery, release or ransom. o9.14, o11.0-­o11.11, UMDAT AL-­SALIK


CONSTITUTION:  FIRST AMENDMENT: Congress shall not abridge “the freedom of speech.”
SHARIAH:  Speech defaming Islam or Muhammad is considered “blasphemy” and is punishable by death or imprisonment.


CONSTITUTION:  FIRST AMENDMENT: “Congress cannot take away the right of the people to pe- tition the Government for a redress of grievances.”

SHARIAHNon-Muslims are not to harbor any hostility toward the Islamic state or give com- fort to those who disagree with Islamic government.


CONSTITUTION:  SECOND AMENDMENT: “The right of the people to keep and bear arms shall not be infringed.”

SHARIAHUnder historic and modern dhimmi laws, non-Muslims cannot possess swords, firearms or weapons of any kind.


CONSTITUTION:  FIFTH AMENDMENT:  “no person shall be held to answer for a capital or other- wise infamous crime… without due process of law.”  SIXTH AMENDMENT:   guarantees a “pub- lic trial by an impartial jury.”  SEVENTH AMENDMENT:  “the right of trial by jury shall be preserved.”

SHARIAH:  “Muhammad  said,  ‘No  Muslim  should  be  killed  for  killing  a  Kafir  (infidel).’” HADITH SAHIH AL-­BUKHARI   Non-Muslims are prohibited from testifying against Muslims.  A woman’s testimony is equal to half of a man’s.


CONSTITUTION:  EIGHTH AMENDMENT: “nor cruel and unusual punishments inflicted.”

SHARIAH:  Under Shariah punishments are barbaric: “Cut off the hands of thieves, whether they are male or female, as punishment for what they have done – a deterrent from Allah.” QURAN 5:38   A raped woman is punished: “The woman and the man guilty of adultery or fornication – flog each of them with a hundred stripes” SURA 24:2


CONSTITUTION:    FOURTEENTH AMENDMENT:  “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

Shariah: Under dhimmi laws enforced in modern Shariah states, Jews, Christians and other non-Muslims are not equal to Muslims before the law.  Under Shariah law, women, girls, apostates, homosexuals and “blasphemers” are all denied equality under the law.

  1. Those Principles are worth defending!

    Politicians no longer talk about Principles. They spend billions on the promotion of promises they don’t intend to honor or don’t really care if they are honored or not.

    Creating our Democracy and the Constitution took a lot of thought and was based on shared Christian Values. It would be foolish to dismiss the fabric that was created by men of good will. They were leaders who were principled and had a clear vision. To attack any part of the Constitution, without the same care that went into constructing it would be foolish.

    Using the Constitution

    The Constitution invites the People to become involved in their future through Referendums.

    It is wise to involve the People so that they understand the threats posed by Islam and the protection offered by the Constitution. If these matters are simply legislated, many people will never be adequately involved. What they hear is the view of mainstream media which has its own agendas. We need to ensure that the People have the ability to better understand the issues.

    Me should plan quality simple referendums in all States that ask the People to endorse US law as the only law in the land.

    A second referendum should ban the Qur’an on the basis that it, like Mein Kampf, serves primarily to fuel anger and dissent . . . civil unrest. It is a book that asks us to accept non-democratic ideals to overthrow the government. It has nothing to do with Free Speech . . . it uses Free Speech against itself. It asks governments to commit suicide.

    The second reason is that the Qur’an is the direct opposite of our values. It is incendiary and has already caused crime to increase.

  2. Dr. Gorka is doing a great service but I have to take exception as I disagree with his choice of verbiage when discussing Islamic Terrorism! Dr. Gorka and this website encourages the kafir to study and understand Islam. I have done just that and continue to do so! Dr. Gorka has pointed out the abject failures of the current administration in dealing with Islamic Terrorism and stressed the fact that WORDS matter. Do we call Christians, Jews, Hindus, Buddhists …….. radicals when they practice their perspective faiths as prescribed by their doctrinal texts? When a Christian practices Loving Their Neighbor who in their right mind would describe these Christians Radical? Any person from the age of 10 and up could read the koran, hadith(s) and sira and see that the muslims who are promoting and doing terror are practicing Islam as prescribed by their prophet and doctrinal texts! These terrorists are not being radical, in fact, they are practicing islam as it has always been practiced! Islam is terror to any and all, and I mean ALL, peoples who will not be subjugated or converted. The so called moderate muslim is either practicing Taqqiya or they are not following islam! There is no such thing as moderate islam and therefore ther is no moderate muslim, period!

  3. Where’s the part in all that goodness we’re defending, that says it’s right for us to be doing everything we claim they’d do, to them first, over there, for the past 30 years?

    • You are correct, however, two wrongs do not make a right and the misguided
      actions of former administrations need to be exposed as well. This does not diminish the threat to all non-Muslim people that Islam overtly promises.
